Detailed List of Contractual Breaches:
Infrastructure Failures: For at least 4 hours, there was no hot water in the room. The TV and Internet (essential for a 5-star stay) were non-functional throughout the duration.
Health & Safety / Maintenance: The SPA was in a state of disrepair. The steam room ceiling is peeling off, with debris falling on guests. The indoor pool was cold (even though celebrated and presented as thermal circuit, and the rooftop pool was unsanitary.
Fitness Facilities: The gym was largely out of order. Only the ergometer functioned; the multi-press is broken.
Misrepresentation of Services (The "Romantic Package"): We were charged €50 for a "romantic room setup" which consisted of plastic rose petals strewn carelessly. This does not meet the standard of a luxury hotel and constitutes a lack of "assured characteristics."
Professionalism: The massage service (~ €110) was significantly below the professional standard of a 5-star spa.
The accumulation of these defects constitutes a significant diminution in the value of the travel package. According to European consumer protection standards and the Spanish Código Civil, I am entitled to a price reduction proportional to the loss of utility.
My Demand:
I hereby request a total refund of €550 (representing a ~30% reduction of the base price plus a full refund for the misrepresented "Romantic Package" and the substandard SPA services).
