Official rules for ‘Holiday You’ competition

The Wotif Holiday You Competition (the “Competition”) is in no way sponsored, endorsed or administered by, or associated with Instagram (“Instagram”) (the “Competition Platform”). You understand that you are providing your information to the Sponsor (defined below) and not to Instagram. The information you provide will only be used for the administration of this Competition and in accordance with the Sponsor’s privacy policy (see below). Instagram is hereby completely released of all liability by each entrant in this Competition. Any questions, comments or complaints regarding the Competition must be directed to the Sponsor and not to Instagram. You may only use one (1) Instagram Account  (“Platform Account”) to participate in this Competition. 

In these Official Rules, the term “you” refers to any person who enters, or who wishes to enter, the Competition. 

1. Promoter: The promoter of this Competition is Expedia Australia Pty Limited ACN 101 694 946 of Level 17, 1 Martin Place, Sydney (”Expedia”) and the Sponsor of this Competition is Expedia, Inc., 1111 Expedia Group Way W., Seattle, Washington 98119 USA. 

2. Eligibility: The Competition is open only to legal residents of Australia who are at least eighteen (18) years old at the date of entry and have a Platform Account and who otherwise meet the requirements set out in these Official Rules.  If you do not have an Instagram Account, visit http://instagram.com and register in accordance with the enrolment instructions for a free Account. Employees of the Promoter or Sponsor, their subsidiaries, affiliates, prize suppliers and advertising/promotion agencies as well as their respective immediate family (spouse, parents, siblings and children and each of their respective spouses, regardless of where they reside) and household members (whether or not related) of those employees are not eligible to enter. 

3. Competition Period: The Competition Period begins at 9am AEST 19 June 2023 and ends at 12pm AEST 30 June 2023.  Entries submitted before or after the Competition Period will not be eligible.  Promoter’s computer is the official time-keeping device for the Competition.  

4. How to Enter: This Competition is a game of chance. To enter the Competition, you must, at any time during the Competition Period, complete the following: 

i. Visit https://www.instagram.com/wotifcom/and follow the page; 

ii. locate the competition post on the page; 

iii. Like that competition post and place a comment in which you tag the Instagram handle of a friend. 

You may also get 1 bonus entry per photo posted of your best holiday self on an Aussie getaway on your Platform Account and tagged with the @wotifcom Instagram handle. 

When entering on Instagram, ensure your profile must be set to public for your entry to be valid. 

 IMPORTANT NOTE: Standard text messaging, data and/or other rates apply to participants who submit a Post via a wireless mobile device. Wireless service providers may charge for airtime and/or data in relation to each standard text message sent and received.  Please contact your service provider for pricing and service plan information and rates before mobile device participation. 

Limit: There is a  limit of one entry (and up to one bonus entry) during the Competition Period.  Entries generated by script, macro or other automated means are void.  Uploading an Entry constitutes entrant’s consent to give Sponsor a royalty-free, irrevocable, sublicensable, assignable, perpetual, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display, such entries in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, media or technology now known or later developed, including for promotional or marketing purposes. If requested, entrant will sign any documentation that may be required for Sponsor or its designees to make use of the non-exclusive rights entrant is granting to use the Entry.  Released Parties (as defined below) are not responsible for lost, late, stolen, damaged, incomplete, invalid, un-intelligible, garbled, delayed or misdirected Entries; all of which will be void. The entrant further agrees, represents, warrants and guarantees to Promoter that: 

a. they have and will maintain all necessary rights, consents, approvals, authorizations, licenses and rights in and to all Entries and all information they contain in order for Promoter and its sublicensees to use the Entries and exercise the rights granted herein; 

b. the uploaded Entry does not include photos or information about children or any third parties without their consent (or a parent or legal guardian’s consent in the case of a child under 16 years of age); and  

c. If the Entry contains any personal data of individuals, the entrant agrees, warrants and represents that they have obtained consent of these individuals for (a) their likeness and/or personal data to be included in the Entry; and (b) the collection, disclosure, transfer, processing and use of their personal data by the Promoter in accordance with these Terms and Conditions and the Promoter’s Privacy Policy, accessible at https://www.wotif.com/lp/lg-privacy 

6. Competition Draw:There will be one (1) winner with respect to this Competition. The random draw will be held at  Gadens, Level 13, 447 Collins Street, Melbourne VIC 3000 on Tuesday, 4th July, 2pm. The first valid entry drawn randomly from the eligible entries received during the Competition Period will win the prize.  The Promoter will notify the winner within two (2) business days of the prize draw, via their post provided in the Competition PlatformThe Promoter may draw additional reserve entries in a draw and record them in order, in case a winning entry/entrant is deemed invalid or a prize is unclaimed (Reserve Entrants). 

7. Promoter and Sponsor’s Rights to Submissions: By entering, you grant Promoter, Sponsors, and their agents, licensees, and assigns an irrevocable, perpetual (non-exclusive) license and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, modify, create derivative works of, exhibit, and otherwise use your entry and all elements of such entry, including, without limitation, responses to the questions, as-is or as-edited (with or without using your name) in any media throughout the world, in perpetuity, for any purpose, without limitation, and without additional notification, review, compensation, or approval from you or any other party.   

8. Potential Winner Requirements: The potential winner may be required to submit to the Promoter and Sponsors their first name, last name, age, email address and proof of ownership of winning Platform Account in order to redeem the Competition prize. 

9. Prize: There is one (1) prize to be won.   

One (1)  winner will receive a prize of one (1) $500 wotif.com coupon for use on a select standalone hotel stay only (the “prize”).   Approximate retail value of the prize: $500 AUD. Total Competition prize value is $500 AUD.  Any difference between the stated value and actual value will not be awarded.

Prize is subject to any additional terms and conditions imposed by the relevant supplier or Sponsor, including, as relevant: 

a. validity period/s; 

b. availability; 

c. conditions of travel (including behaviour requirements); 

d. travel dates and specified travel exclusion periods;  

e. any additional fees (payable by you) relating to changes made by you to a travel prize after it has been booked; and 

f. a requirement to present your credit card when checking in to accommodation. 

Winner is responsible for paying all applicable federal, provincial, state, local, income and withholding taxes, if any.  In the event that any tax withholding is required by law for the prize, a winner authorises Sponsors to make the corresponding deduction. Any prize details not specified above will be determined by Sponsors, in its sole discretion. Winners may not transfer, assign or substitute the prize, or redeem prizes for cash, except at the sole discretion of the Sponsors, who reserves the right to substitute the prize (or portion thereof) with one of comparable or greater value. Prize must be accepted as awarded. Prizes are awarded “as is” without any warranty or guarantee, either express or implied by Sponsors.   

The prize will be provided by the Sponsors. Specific Prize details are at the discretion of the Sponsors. 

Winner is responsible for all other unspecified costs related to your prize, including meals, transport, insurance (including excesses), in-room charges, taxes, mobile or data plans, installation costs, costs associated with ongoing use of the prize, etc.     

Winner accepts that some aspects of a prize may be inherently risky and that the prize may involve dangerous activities.  The Sponsor for the Prize, its associated agencies and companies make no representation as to the safety, conditions or other issues that may exist at any destination.   

In respect of the Prize, you expressly acknowledge that undertaking such travel or activity is at your own risk and sole discretion and you will make your own assessment of the risks and of your own suitability to participate in or to undertake such activity or travel. 

10. Unclaimed Prizes: In the event the prize winner fails to claim his or her prize by Tuesday, September 5, 2023 or if after making reasonable attempts the Promoter cannot contact the winner (or the winner does not contact the Promoter), the prize winner will be deemed to have forfeited the prize and will not be entitled to any supplementary prize or benefit. The Promoter will re-award the relevant prize to a Reserve Entrant. Any winner will be informed in writing within 2 days of determination. Disposal of any unclaimed prize may be made subject to any written directions given by any government authority and pursuant to any relevant legislation.  

11. General Conditions: In the event that the operation, security, or administration of the Competition is impaired in any way, the Promoter may, in its sole discretion, (a) suspend the Competition to address the impairment and then resume the Competition; or (b) award the prizes according to the criteria set forth above from among the eligible entries received up to the time of the impairment. Promoter reserves the right, in its sole discretion, to disqualify and seek damages from any individual who tampers with the operation of the Competition, violates these Official Rules, or acts in a disruptive or unsportsmanlike manner. Promoter’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to the Promoter or the Sponsors by mail shall not be deemed proof of receipt of that communication by the Promoter or the Sponsors (as applicable). The Competition is subject to federal, state, and local laws and regulations, and is void where prohibited. 

Where there is a dispute between you and Promoter and/or Sponsors regarding the conduct of this  promotion or claiming a Prize, the Promoter and/or Sponsors will endeavour to resolve the dispute with you. If the dispute cannot be resolved the Promoter and/or Sponsor’s decision in connection with all aspects of this competition is final. 

12. Collection and Use of Your Personal Information: Sponsor may collect  your personal information directly or through our agents or contractors. We will use your personal information as necessary in order to conduct and manage the Competition, and, where we have a lawful basis to do so, to send marketing communications to you. We may disclose your personal information to our related companies, agents, and contractors to assist in conducting and managing this competition, communicating with you, or storing data. This may include disclosures to organizations outside Australia in places such as the United States.

13.  Release and Limitations of Liability: Nothing in these terms and conditions restricts, excludes or modifies any consumer rights under any statute including the Competition and Consumer Act 2010 (Cth).  

Without limiting the previous paragraph, by entering, you agree to release and hold harmless the Promoter and Sponsor, their respective parents, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Competition or receipt or use of any prize, including, but not limited to: (a) unauthorised human intervention in the Competition; (b) technical errors related to computers, servers, providers, or telephone, or network lines; (c) any errors on the Competition site that may impact may entry; (d) printing errors; (e) lost, late, postage-due, misdirected, or undeliverable mail; (f) errors in the administration of the Competition; or (g) injury or damage to persons or property. You further agree that in any cause of action, in no event shall the Released Parties be liable for attorney’s fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. 

14. Disputes: Entrants agree that any and all disputes, claims and causes of action arising out of, or connected with, the Competition or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in New South Wales, Australia. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Promoter or the Sponsors in connection with the Competition, shall be governed by, and construed in accordance with, the laws of New South Wales, Australia, without giving effect to any choice of law or conflict of law rules (whether of NSW or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than New South Wales, Australia. 

15.  Results: The winner will be announced within 2 business days of the prize draw on the following https://www.wotif.com/vc/blog/holiday-you-competition/ and displayed for a period of 28 days.
