Uniquely Aussie Awards<\/span><\/b>\u00a0<\/span><\/td>\nChance plays no part in how the Uniquely Aussie Awards will be awarded.\u00a0 Uniquely Aussie Awards for each category will be awarded based on the number of valid Nominations received by each eligible destination, event, item, place or business as part of this promotion, plus the Sponsor\u2019s choices. \u202fThe Sponsor reserves the right to award all Uniquely Aussie Awards to an eligible destination, item, place or business in its sole discretion.<\/span>\u00a0<\/span><\/p>\n

The first valid entry drawn randomly from the entries received during the Competition Period<\/span> will win the prize.<\/span>\u00a0<\/span><\/p>\n

The prize is a $2,000 travel credit to use towards Australian domestic travel in one transaction, as available at Wotif.com. Bookings over $2,000 will be discounted by $2,000. 12. Your entry must be received during the Competition Period and will be <\/span>deemed to be received only when received by the Sponsor. You will receive an on-screen message<\/span> confirming your entry.\u00a0 <\/span>The Sponsor is not liable for any problems with communications networks.\u00a0 <\/span>You are responsible for your own costs associated with entering.\u00a0<\/span> If you enter using automatically generated entries or multiple phone numbers\/email addresses\/addresses\/aliases, you may be disqualified.\u00a0\u00a0<\/span>\u00a0<\/span><\/p>\n

Prizes<\/span><\/b>\u00a0<\/span><\/p>\n

13. Prize\/s <\/span>and<\/span> all elements of prize\/s must be taken as and when offered or will be forfeited, and if forfeited, the Promoter and Sponsor will not be liable. <\/span>Prize\/s are <\/span>subject<\/span> to any additional terms and conditions imposed by the relevant supplier or Sponsor, including, as relevant:<\/span>\u00a0<\/span><\/p>\n

(a) validity period\/s;<\/span>\u00a0<\/span><\/p>\n

(b) booking and availability of flights, accommodation and events;<\/span>\u00a0<\/span><\/p>\n

(c) conditions of travel (including behaviour requirements);<\/span>\u00a0<\/span><\/p>\n

(d) travel dates and specified travel exclusion periods;\u00a0<\/span>\u00a0<\/span><\/p>\n

(e) any additional fees (payable by you) relating to changes made by you to a travel prize after it has been booked;\u00a0<\/span>\u00a0<\/span><\/p>\n

(f) a requirement to present your credit card when checking in to accommodation; and<\/span>\u00a0<\/span><\/p>\n

(g) a requirement that any person taking the prize that is aged under 18 years old must be <\/span>accompanied<\/span> by their parent or guardian at all times.<\/span>\u00a0<\/span><\/p>\n

14. You are responsible for all other unspecified costs related to the prize, including meals, <\/span>transport<\/span>, insurance (including excesses), in-room charges,<\/span> additional taxes, mobile or data plans, installation costs, costs associated with ongoing use of the prize, etc.\u00a0<\/span>\u00a0<\/span><\/p>\n

15. The Promoter and Sponsor are not responsible for any dispute between you and any person with whom you choose to, or choose not to, share the prize.<\/span>\u00a0<\/span><\/p>\n

General<\/span><\/b>\u00a0<\/span><\/p>\n

16. Any failure by you to comply with the conditions imposed by the prize supplier(s) may result in the prize being cancelled or withdrawn without liability for the Sponsor or the prize supplier(s).\u00a0<\/span>\u00a0<\/span><\/p>\n

17. For travel prizes, you<\/span> accept that some aspects of the prize may be inherently risky and that the prize may involve dangerous activities.\u00a0\u00a0<\/span>\u00a0<\/span><\/p>\n

18. You must, if required by the Sponsor, sign disclaimer and release forms provided by the Sponsor in favour of the Sponsor and other parties before taking the prize.\u00a0 If you do not sign, your entry will be deemed invalid and you will lose any entitlement to a prize.\u00a0<\/span>\u00a0<\/span><\/p>\n

19. If you or your entry are deemed by the Sponsor to breach these Terms and Conditions including if the prize is on set dates and you are unable to take the prize on the relevant date\/s, your entry (or at the Sponsor’s discretion, all of your entries) may be discarded.\u00a0 The Sponsor may, at any time, require you to produce documentation to establish to the Sponsor’s satisfaction the validity of your entries (including documentation establishing your identity, age, place of residence and place of employment).\u00a0 Failure by the Sponsor to enforce any of its rights at any stage does not waive those rights.\u00a0<\/span>\u00a0<\/span><\/p>\n

110. You must not:<\/span>\u00a0<\/span><\/p>\n

(a) tamper with the entry process;<\/span>\u00a0<\/span><\/p>\n

(b) engage in any conduct that may jeopardise the fair and proper conduct of the competition;<\/span>\u00a0<\/span><\/p>\n

(c) act in a disruptive, annoying, threatening, abusive or harassing manner;<\/span>\u00a0<\/span><\/p>\n

(d) <\/span>do anything that may diminish the good name or reputation of the Sponsor or any of its related entities or of the agencies or companies associated with this competition;<\/span>\u00a0<\/span><\/p>\n

(e) breach any law; or<\/span>\u00a0<\/span><\/p>\n

(f) behave in a way that is otherwise inappropriate.\u00a0\u00a0<\/span>\u00a0<\/span><\/p>\n

111. If you (or your companion\/s, if applicable), in the opinion of the Sponsor (and\/or a medical professional, as relevant to the circumstances), are intoxicated, under the influence of alcohol or any other drug, behave aggressively or offensively, or behave in a manner which may diminish the good name or reputation of the Sponsor or any of its related entities or the agencies or companies associated with this competition, is contrary to law or is otherwise inappropriate, the Sponsor may cancel the prize or restrict you (and your companion\/s) from participating in any elements of the prize, at its discretion.\u00a0<\/span>\u00a0<\/span><\/p>\n

112. The Sponsor is not liable for entries, prize claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or incorrectly submitted including failure of any third parties to forward entry forms for inclusion in the draw, where relevant.<\/span>\u00a0<\/span><\/p>\n

113. Where there is a dispute between you and Promoter and\/or Sponsor\u00a0 regarding the conduct of this promotion or claiming a Prize, the Promoter and\/or Sponsor will endeavour to resolve the dispute with you. If the dispute cannot be resolved the Promoter and\/or Sponsor\u2019s\u00a0 decision in connection with all aspects of this competition is final.<\/span>\u00a0<\/span><\/p>\n

114. <\/span>Prizes cannot be transferred or exchanged nor (except where cash is specified) redeemed for cash.\u00a0 Without limiting any other term of these Terms and Conditions, all prizes (and elements of prizes) must be taken as and when specified, or will be forfeited with no replacement.\u00a0 The prize values are correct as at the date of preparing these Terms and Conditions and include any applicable GST.\u00a0 The Sponsor is not responsible for any change in prize value.\u00a0 You agree that if a prize (or element of a prize) is unavailable for any reason the Sponsor may provide another item of equal or higher value, subject to any necessary approval by the state\/territory gaming authorities. <\/span>\u00a0<\/span><\/p>\n

115. If publication will take place, by entering, you request that your full address not be published.<\/span>\u00a0<\/span><\/p>\n

116. If this competition cannot run as planned for any reason beyond the Sponsor’s control, for example due to software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure, the Sponsor may end, change, suspend or cancel the competition or disqualify affected entries\/entrants, subject to any necessary approval by the state\/territory gaming authorities.\u00a0<\/span>\u00a0<\/span><\/p>\n

117. The Sponsor is not responsible for any tax implications arising from you winning a prize.\u00a0 You should seek independent financial advice.\u00a0 If for GST purposes this competition results in any supply being made for non-monetary consideration, you must follow the Australian Taxation Office\u2019s stated view that where the parties are at arm\u2019s length, goods and services exchanged are of equal GST inclusive market values.<\/span>\u00a0<\/span><\/p>\n

Liability<\/span><\/b>\u00a0<\/span><\/p>\n

118. Nothing in these Terms and Conditions restricts, excludes or modifies any consumer rights under any statute including the <\/span>Competition and Consumer Act 2010 <\/span><\/i>(Cth)<\/span>.<\/span><\/i>\u00a0<\/span><\/p>\n

119. Subject to the previous paragraph, the Promoter, Sponsor and the agencies and companies associated with this competition are not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury<\/span> (including allergies, skin conditions or other reactions, as relevant),<\/span> illness or death suffered in connection with this competition or any prize, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law).\u00a0\u00a0<\/span>\u00a0<\/span><\/i>\u00a0<\/span><\/p>\n

120.
